Resealing of United Kingdom and New Zealand Probates

When the value of the Australian listed securities in a holding is greater than A$25,000 the registry will usually require the probate to be resealed in Australia. Sometimes this can be avoided and an Insurance Indemnity Bond supplied instead when the value of the securities is less than A$65,000. (See separate section re Insurance Indemnity Bonds)

The resealing of an overseas probate in Australia is similar to applying for a new probate and the requirements and costs vary from state to state

The resealing of a probate must be completed in a state where some assets are held by the estate.

Details of the requirements to enable the resealing to be completed in Victoria are detailed below.

The legal, probate office and other fees could amount to approximately $2,000 and the resealing process take over three months to complete in Victoria. Completion can take longer in some other states.

We suggest that the securities be transmitted into the name(s) of the executor(s) following the completion of the resealing process, as this can overcome problems of delivery following any sale of the securities.

Australian registrars will, when registering the transmission into the executor/s name/s, include a holding designation including the name of the deceased. This creates difficulties when selling the securities as the buying brokers are not sure if the registry requirements have been complied with.
To avoid this problem it is necessary to request registries not to include any designation when lodging the transmission for registration.
